BMW can easily address this, but they won't. I'll bet you their engineers were crying how placing an oil cooler on the bottom of the car without any protection was madness, but they don't get the last word. Bean counters look to cut cost at every corner, and they deem the risk of catastrophic failure as low. They know it will fail sooner or later, but they've assessed that most instances will not end up needing a new engine.

I also wouldn't say BMW is considering anything. Technicians at dealerships who work on these cars know bad design when they see it. I've had techs gripe to me many times about certain design flaws but that's not the same as BMW revaluating the design. Sadly, my expectation is anything they report back will fall on deaf ears. I don't expect anything to change unless there's a class action. All owners can do is take preventative measures like installing protection or accept the risk and hope for the best.
