IMPO, Because some idiots run with their fog lights on all the time, and the extra bright rear light is a real pain to those following. The quality of the training and driving skill of the average US driver is really poor compared to, say those in Germany. If people only used them when needed...say in fog or heavy precipitation, then they'd be a safety device, otherwise, they're a liability. It is also possible that the lense/reflector may be different. , but I don't know that. While not all that much higher, a constant high(er) wattage bulb could melt things if not designed for it.
