With that said, most insurance companies will automatically refuse to pay as standard practice and make you fight them. As you stated your insurance could care less since the $250 will not be paid by them no matter what so they have no interest in helping.

As a matter of the witness, who are they, were they passengers in his car. This could be a ploy on the insurance companies part so get their names and addresses and relationship to the driver.

The other thing you can do is file a claim in small claims court and hope the person nor his insurance company shows up and you win automatically and you show them the judgement and they most likely will pay since it now will become too costly to try and appeal the decision.

A friend of mine did this when a local mechanic totaled his BMW when he took it home for a joy ride, the insurance company for the muffler shop refused to pay since they claimed guy did not have permission to take the car they claimed he stole the car and therefore the insurance company had no responsibility. Well he took it court and the judge agreed with my friend and the insurance company did not show so he got an automatic judgement in his favor. The insurance attempted to appeal the decision but in the end they paid since it was going to cost more to fight.

I walked into the gas station where accident happened and asked for the security camera footage. Gave them a blank CD and the next day had the video.

Sent it to my adjuster who looked at the video and said that the accident was not my fault in any way.
Video also showed that the dude who hit me did not talk to a single person, except me, before he left, so his story
about witnesses is a load of bullshit.

Sent the video to Liberty Mutual (other dude's insurance) and these cheap fucks sent me a $125 check instead of $250. Oh well... at least I got something.

here you go. i had to increase the frame rate, or you would be looking at 20 minutes of this bullshit. basically i had the right of way, but since the dude was looking backwards, he did not see me.

at the end he walked into the gas station to get a coffee, but by that time all of the possible witnesses were gone.

Sorry dude. I think it's your fault, but it's hard to tell due to the fact that the video is not in real time. It seems that the Prius was already moving forward when you were to the right of him.

Captured a frame from the video. At that point, the prius has already started to move forward. Should have taken a wider turn and leave more room between you and the prius just in case this kind of thing happens.

Also, there was a witness at 0:14 and 0:18 - guy in blue t-shirt and he seems to work there or something.

maybe. but from what my insurance adjuster is saying, it is not my fault. and if it was really my fault, would his insurance company pay me anything? nope.

i guess they may have determined that its a 50/50 blame, so they sent me money for half of the damages. not sure, i did not talk to his insurance after sending in the video.

If it's 50/50 blame, your insurance will cover your vehicle and his will cover his vehicle - at least in the state that I'm in.
