I could enter a legally binding contract with you to sell you a 2027 M3 by June 2028 for a fixed price today even though the car hasn't even been envisioned yet. We could set the price at a fixed amount, make it variable based on OEM MSRP or make it based on the market price of mangos. The fact that I might not ever get a car to sell, the fact that BMW might not make a car or the fact that pricing might make me loose a ton of money doesnt prevent us from contracting... but smart businesses (and individuals) don't sign contracts that could expose them to risk/damages - e.g. for breach due to circumstances not within their control where the contract terms don't give them an out. In a business/individual person transaction there are also risks to the business that don't exist with contracts between solvent businesses. Large corporations don't generally enjoy suing random guys for breach of contract... the optics are bad and getting paid damages is hard too. Whereas if the contract favors the individual they will likely be forced to live up to it. If you sign an agreement the devil is in the details though. And the details normally help the OEM get out more than you... because their lawyers write and review them. Last edited by spurcap; 02-22-2025 at 06:04 PM.. |

For those of you who are wondering why your cars haven't moved anywhere in the past couple of weeks or so (including mine), this is a probable factor:
https://g80.bimmerpost.com/forums/showthread.php?t=2165655 Service Action/SIB, dated 2/6/25, for a DME software update, affecting G8x and F9x vehicles, including the G87 M2. Thread above is in the M3/4 forum. It's being passed off as 'optional' by BMW AG, but the more digging folks have done into it (and the more types of actions that dealers have been taking with implementing it on both owned cars and cars in delivery), the more changes are being revealed within the update.

Here in California, you don't actually own a car until you drive it off the lot.

In any normal agreement. even with a normal binding agreement you wouldn't own a car until you accepted delivery. That would be the customary point of title transfer... otherwise you would need to buy insurance while the car is still at the factory! The point would be that backing out by any party would be potentially subject to damages. |

My TP order had been at Step 10 (Ready for Transport) for about two or three weeks. This morning I checked and its jumped to step 14 ( In Transit ) All that's left is for it to show up at the dealer! Original order was placed back in July, its almost time!

genius was useless. no more info than i got out of the app or website. after the five weeks of nothing, my CA had the dealership GM work his contacts with BMW to find the car at the port and what ship it was getting on. depending on what port it is coming into, the shipping schedule is the driver. it will sit in the factory lot until the correct ship is close to the MX port. only then will it be sent by train to the MX port of departure. the ships to a US port can be a month apart. |

it is good the cars don't sit in the port long. the parking lot is literally right on the beach catching all the salty breezes off the gulf of mexico. |

Good point on the holding location, that makes sense to keep them at the factory.
It must have known -- just moved to In Transit this morning. I'd already sent an inquiry to Genius yesterday to see if it might've been on a boat without updating, so hopefully I'll hear back today to know which one it's on. Either of you see an updated status as well? |

Man I hope this tariff stuff resolves and goes away or something happens before your car gets to port and hits customs. You’ve already gotten screwed waiting in the factory parking lot forever. You definitely don’t deserve getting screwed with tariffs on top of that.
