I highly doubt the dealership is going to keep his thousand bucks. For starters, most states have laws against it and $1000 isn’t worth their time or the hassle to keep it. Contrary to what people read on forums, it rarely happens unless it is some really weird build (usually Porsche etc).

My car came in when I was out of town on a work trip. Drove me nuts after all that waiting, knowing it was at the dealer for 3 days before I could see it. But the dealer had no problem holding it until I got back. I think the issue is how you expressed that you may not buy it. I bet car salesman deal with a ton of people who waste their time and "might buy" cars then never do.

I appreciate the OP. It's people like him that allowed me to jump my dealer's list to get a car sooner. When there are more serious buyers waiting the dealer has every right to move on to someone who is more committed.

So to sum it up, you drove to a BMW dealership in your Subaru and wanted to buy an M product. Even put down $1,000 as a deposit on one.
Got cold feet because of the price of the car. Needed an excuse to back out so you made one up. And now posted on a online BMW forum for the best way to get the deposit back. Sorry we couldn't really be of any assistance. Here are your real options 1. Buy the car. Start the actual process by filling out the loan application and so forth. 2. Wait for another car to come in and buy that car when you are financially ready, the dealer still has your deposit. 3. Tell the dealer you aren't ready and ask for the deposit back. 4. Tell the dealer you aren't ready and let them keep the deposit. It's just a car and it's just a grand. You'll be fine.

This guy is so all over the place
"Help dealer is screwing me" (title of the thread) over a $1k deposit "I have the means to buy every M car at the dealer" "I dont care about the 1k" (despite actual empirical evidence that he does in the original post) "I'm happy to be saving all that tax and insurance money" You couldnt be giving off I'm in debt up to my eyeballs but I make a somewhat decent salary vibes any harder. Given what we know so far: Surgeon, just in their fellowship or first year, but has 1-2M in student loans. They didnt actually see a child die but one did die on their floor a few months ago. "Drives" a subaru but I put drives in quotations because he spends 90hrs a week being an errand boy for the real surgeons and hitting on nurses in the lounge. Decided to get a BMW so he could brag to people on the floor about it, but all the nurses and PA's just roll their eyes at him because they know the BMW is actually just a bad financial decision. Claims to have owned an R8 gated manual which is a wild card... im gonna go with "it was my car but my dad technically owned it"

IMO, I'm sure the dealer and its paperwork say that the deposit is non-refundable. If not, then you have a valid case as far as the deposit goes.
But, that car belongs to the dealership until you actually SIGN the contract. Up to that point they can do whatever they want with it including selling it out from under you. Is that good business? Maybe not. But it's perfectly legal.

The guy made a strategic mistake and told the dealer his options and that he might not take delivery.
If you an to make up you mind once the car is there, you don't tell the dealer. I don't think the dealership is being unreasonable. Guy may or may not buy the car and has said that. Sure fire deal comes in, they take the money. This is just business.
