Would be nice to try and write some kind of commentary or follow up to the article detailing exactly who the occupants were in the collision. It seems to be written as if everything was "a-ok" post-accident, whereas you and your passengers obviously have injuries that need to heal.
It's not like she had hit a car with four healthy college-aged dudes but rather a pregnant woman and another woman with a now-broken nose. That polished "realtor image" will tarnish quicker when people know of her true behavior and recklessness. Get a good lawyer asap. Even if you can't get her criminally you can sue the crap out of her. Clearly they have some assets worth going after.
The fact that she was found drunk shortly after, DWI for the 3rd time, 4 of you vs 1 of her you should EASILY be able to get an award. I suspect she will want to settle out of court fairly quickly. I would get a lawyer NOW.

Three points I'd like to give you: 1) please be a good witness to you Crown (court appointed lawyer that will try her criminally). Spread your unwillingness to take a plea bargin from her defense, but be willing to attend court. This is one ofthe most important things you can do. A judge seeing four adults get on the stand and explain how she altered their lives and almost killed an unborn, they are far more lowly to hand out actual jail time (which she will certainly grey to avoid via a plea bargin. She refused to comply with the breath demand so she has lost the ability to argue certain things in court, and plea is one of her only outs. Also be sure that your crown KNOWS, that you are willing to testify to the fact that you saw her as the driver, and you also watched her until the police came and she did not drink anything in that time. 2) sue her civilly. That will hurt her big time and will be fairly easy to do based on what happened. Take everything you can, only because it needs to happen. When you finish, she will need to recover for years. This needs to end up worse for her than you. This is how you make that happen. Drive the point home. 3) I THINK THAT E90POST can help!! Anyone remember back on bimmerforums that guy with the "ninja business" or what ever that stole a parking spot and everyone started messing with his company? Thank God you were safe. That looks awful and glad to see you made it out with very little injuries. Hopefully, you can get something positive out of this - like a judgment or getting her put in jail.

i guess NY don't have that 3 strikes and you're out law like CA? (or at least I think CA still does). If she was in CA, I think she gets life in prison no? Glad you guys are ok. Hope she gets punished to the full extent of the law

The problem with the system is that DUI is very profitable for the state. If we wanted to eliminate DUI we could, all we have to do is make the consequences stiff enough.
