Someone broke into my E93 - doors unlock itself

Hi all,

I own 2009 E93.
Last week one of the two smart access fob stopped working, lets call this remote fob#1.

I replaced battery on both of my fobs, fob 1# and fob 2# worked fine for few days.
Then last weekend I went to out of state for few days and realized that fob #1 is acting up weird.

Fob #1: When I press "unlock" button one time all doors unlock, windows and convertible top rolls down.
Fob #1 : When I press "lock" button one time nothing happens
Fob #1 : Will NOT start the car unless it is inserted in the slot.

Fob #2 works just fine, locks, unlocks, starts even if fob is NOT inserted in.

While I was out of town I parked my car at the hotel's parking lot and locked the doors with fob #2, confirmed all doors are locked properly and left.
When I came by to my car in the morning I found out that my doors are unlocked and someone slept in the car overnight, some of my belongings were missing.
Nothing expensive (total may be $200)
Of course I freaked out but whats done is done.
So, I got in the car, inserted fob #2 in the slot, started driving back home (few hundred miles) while I was driving car unlocked itself few times, then I locked it by pressing "lock" button on the console but it unlocked few more times.

This morning I found my car "unlocked" in my garage.

I was thinking my fob #1 unlocks the car automatically for some reason but I was at 15th floor while I was staying at the hotel and fob #1 wont reach from 15th floor to parking lot unless car was unlocked right after I locked the car with fob #2.

Any idea what could be wrong?
This is driving me crazy.

Sounds like the button on fob 1 is stuck in the depressed position.

Exhibit: the windows rolling down

So it's very possible that fob 1 did unlock the car, as you walked away.

I just removed the battery on Fob 1 and left it home, let's see if anything changes.

Yes.
First I tried to lock doors with Fob #1, I could hear a click coming from trunk area but it wouldn't lock, then I used fob #2 to lock, verified all doors are locked properly and walked away.

As other person mentioned here fob#1 might have unlocked doors while I was walking away from the car but I never noticed.

Is there anyway to reset fob #1 to default in case if programming is messed up?

Dealer will have to do that and it will not be cheap.
Also no one broke into your car with the doors unlocked just some dirtbag taking the opportunity to use your car as a motel...

I have a similar comfort access fob from my previous E92, same year and looks the same.
Is it possible to open them up, swap internal parts?

Edit: According to this video it is not possible to open shell without destroying it.
Can I somehow have get E92 comfort access fob programmed for my E93?
I have K90 Key Programmer which I used to program few fobs for my old E46, not sure if its compatible with E9X?

CA key can be opened to change the battery AFAIK - I have CA, and I can open the fobs without cutting them open.
Regular fobs have the rechargeable battery and need to be cut open in case a battery goes.
