Got out of another pricey ticket

Whats up guys! I'm so relieved. I got a letter today from the SD superior court saying that my case has been dismissed and my $539.00 bail is being returned to me.. !! I got a ticket in January for driving in the carpool lane during heavy traffic after work. First offense in CA was 539.. Ouch. Won't be doing that again.

Anyway, this is the 5th ticket I've won using the Trial by written declaration. The officer yet again failed to return his declaration of facts..

What I've noticed about fighting your tickets is that when you show up to court in person, the officer has incentive to go because he is paid overtime bonus to stand there ...

BUt when you use Trial by written declaration, he says to write a document stating the facts against your document and they have no incentive to do this as they do not get an overtime bonus. I'm sure most officers dont want to read an "essay" and write a counter argument.

The only thing about this process is that it takes about 4 months for them to process the whole thing (I delayed my original court date) and it takes another 6 weeks to send me a check. Plus, if you lose your trial by declaration.. You can do a trial de novo which is an in person trial with the cop .. Basically you have 2 chances to win!

But hey, the money is gone already, when I get it again.. it's basically like a receiving a GIFT Free mod money hahaha

Just thought I'd share. So if any of you want to fight tickets, use Trial by Dec... I've gotten out of Red light camera, rolling a stop sign, speeding (x2 based on faulty radar evidence) and now the HOV violation

Definitely a good tidbit. Trial by declaration definitely a good option..doesn't hurt to try. Unfortunately for my speeding tix case a year and a half ago, it didn't help me, and the Kern Co. superior court still made me pay the fine, fee, and online school anyway. I still have my old stuff though, so in case I get another speedo, I'll do this trial by declaration once again, and this time, I will surely write a whole novel, not just an essay!

The best way to win is not to get a ticket in the first place.... If you think about it you end up wasting 20-30 mins with the cop on the side of the road and unless you going on a 100-200 mile trip its not worth it to speed to the point of getting caught... Keep it 10 over streets and 15 over on freeways and you will be fine. And if you get a ticket for going that speed^^^ then you need to learn how to talk you way out of tickets just remember they are human and have heard every pice of BS you can think of and a little honesty can go a long way.

No, did not hear anything about ticketassassin, but definitely will keep these guys in the back of my pocket for future tickets as I know for sure I'll get one. I have fortunate and been close several times, but if I keep going over the limit, for sure I'll get a speedo one day
