Cancelling/returning car (advise please) UK

Hi all just seeking some advice regarding returning my car. Just not overall happy with it for what I'm paying.

I'm in the UK and my finance agreement says I have 14 days to withdraw. I misunderstood this as I have 14 days to give the car back. Like an idiot. I even asked BMW and they said yes but apparently now that's only for used cars.

So does this 14 days thing mean I can withdraw from the finance but they don't have to take the car back? Leaving me with the bill?

Finally there is a 30 day right to reject due to unsatisfactory quality. My arguments would be around the paint.

Some staining in the gloss black. Lots of swirl marks and also there was actually a chip on the edge of the door as well.

reckon I could used these to claim it was unsatisfactory?

I don't know the rules with UK, but if the car has been in your possession for any amount of time, it will be hard to prove that the cosmetics came from the dealership/factory. A dealership will always argue that chips, swirls, etc could have happened while in your possession.

I assume the car market is on fire as it is in thr US, you may be better off selling f private party. Should be able to make some profit with this in demand and scarce vehicle. Good luck.


On a side note, I agree that I feel the paint thickness /quality is subpar to past bmws. My 2017 230i had one rock chip the entire time I owned it. I've had my 9240i for 5 months and there's rock Chips on the fenders, headlight, side mirror, and even the damn roof. How??

I don’t think you’ll be able to return a car after taking delivery simply because you’re no longer feeling it. The issues you’re having are minor and can be fixed for less than £25

Well I wouldn't say as cheap as £25 but yes they're small issues. Issues within the first 30 days none the less which in my mind would entitle me to a refund. But maybe not.

The 14 days relates to the finance, so you could settle without any penalty charges or interest being paid, but you obviously need the cash to do this.
Being that the G42 is still quite a rare car & hard to get hold of in the UK I would’ve thought you’d be able to sell it on the used market yourself, if it’s an M240 I’ve seen quite a few for silly money at around £63k on Autotrader. So I’m sure you could break even at the very least, if not make a profit with any G42.

Like I said you need to do this within the 14 day period to avoid finance charges.

I don’t think you would manage to reject a car on the paint issues, I believe legally you would have to give them the opportunity to put the issue right and as noted already they could fix that fairly easily

My dealer's offered to buy the car back with £5k depreciation. Even when I explained how inflated prices are. They're aren't having any of it.

Well it's financed so I'd have to cancel that unless I can sell it to a dealership that can settle finance. As an individual can't buy the car from me while it's on finance. And selling privately can obviously take quite a while. I'd have to settle very soon in order to avoid the interest then potentially have the car sat in the market for a month! And I don't really know what I'm doing. Case of buyers remorse really

Just drive the car and enjoy it. It will get dirty, get stone chips, get more swirls. It’s never going to be 100%. I’ve had quite a few ‘brand new’ cars now. They all go the same way - none have ever been perfect on collection.

Just get it detailed professionally if you really want that ‘brand new’ feel you want - it will however get dirty again within 5 mins.

Cars are meant for driving. I might seem like a tool here. But these definitely ain’t for sitting in a garage to look at and never getting used, they are an m-lite bmw. Nothing truly special.

I should also say my financial situation may change soon or I'd like to change it…

Basically having a midlife crisis and would quite like to quit my job!

My friend did something similar to yourself with a Porsche Boxster. He sold it privately. He had the buyer pay the settlement to the finance house with him in front of them, he actually went to the bank with them, but you could have them do it over the phone or bank transfer

I would request the settlement letter from BMW financial services (or whoever the finance house is) that way you have it with the correct balance owed and with the finance house bank details for settlement etc.

I’ve always used Autotrader, but I’ve heard Piston Heads is good

Being a regulated agreement you wouldn’t pay that much in charges, certainly far less than the hit the dealer is offering you!

Get a settlement figure from bmw and then do the usual Carwow, motorway, webuyanycar options and see what they will offer. Then take a look at autotrader, there a number of specialists selling nearly new cars for over 10k above list price. See if they’re interested in yours
