Higher lease payment due to CA sales tax increase

My payment just went up $5 ...
Not a big deal obviously, but I kinda thought that if you leased a vehicle under the old sales tax rate, that rate would be grandfathered for the duration of the lease

Not really. You are paying the tax in form of monthly installments so it's the current effective rate that should apply. You can in a same way say that you owe the state the interest on the sales tax that you are paying in pieces instead of 1 lump sum.

EDIT: so what's the sales tax rate now in Cali.

LOL! One thing that never gets grandfathered in are taxes. It is not like you locked into an interest rate. You pay whatever the current rate is for that months payment.

I know what the OP is driving at, because after all, it's a car. On a rented item, why would the owner have to pay sales tax? Or maintenance? Simple, it's in the agreement and he or she agreed to it.

And if they accept that, why would it vary? You either rent it, or own it. Imagine owning something purchased in 12/06, and being asked to pay additional taxes on it. Constitutionally, I've heard that the way around it is to say it's a use tax, not a sales tax. We're taxing your usage, not the sale. Just alot doesn't add up when it comes to leasing. It'd be like saying the landlord just got a new property tax bill and the tenant has to pay for it. Yeah, right. Next thing you know the tenant has to maintain the apt. as well.

i still dont understand, i mean mine only went up 5 bucks too...but thats so anoying i dont wana to sound like a wana be lawyer little kid but in the contract it clearly states 36 monthly payments of 599.99....so doesnt them raising the peoples payements who ALREADY PURCHASED/LEASED the vehicle BEFORE the tax raise go against the contract?

i was more mad them having the balls to do it...then money its self...plus i liked the idea that my payemnts started with a 5 ! which seems relativly less then a 6 ! or 7 !

All leases are generally quoted WITHOUT the tax. Here in PA, the state sales tax is 6%. BUT the tax on auto leasing is 9%. If CA rasies the tax, then your monthly payment will obviously go up.

I rent a hanger at a local airport. The hanger was built with federal funds and is owned by the city.
I still have to pay property tax on the assessed value of the hanger since I am renting it and have what they call a “present possessatory interest.”
They also charge me property tax on the aircraft I have parked there as well.

Don't expect the lease company to eat the increased taxes. Your contract is for the lease, not the taxes. The only legal way to have avoided this was to prepay the entire lease up front in one lump sum. I do believe I was offered that option when I signed.

If you are financing, the sales tax has already been paid at time of purchase so you are safe.

That makes total sense, again, constitutionally, for it to be 9% I'm sure it's not called a sales tax. I just don't get why people who lease feel ok with all these terms that are written against them. I have yet to see a cost-benefit analysis (and there have been countless) on this forum which takes into consideration what you mention, 9% v. 6%. On 55k, that isn't nothing. Ok, that's right, on 20k, that isn't nothing (the former is full value like IL and TX, the latter is most everybody else). $600 here, $725 there, $550 over there, a bunch of fees that have nothing to do with anything, yet people pay them to sign and drive. What are you even thinking in IL or TX where you are taxed on the full value of the car when you are leasing it? At what point does a consumer say whoa, these terms are stacked against me, F you I'm buying it or buying what I can afford?
