high pressure fuel pump problems?

hi, I am driving a 335i conv 2008. And I am having high pressure fuel pump problems, but I have a question to ask. Is the pump a factory default problem that needs to be replaced whether my car is under warranty or not. Or must the car still be under warranty for this problem? thanks
