Help!! just purchased vehicle but noticed a problem!!

Hi all,

Been around these forums for a long time now and just purchased a 2007 E92 335i that was originally leased by my friend. Everything went smoothly until we were just about to take delivery. My mom who was with me sat in the passenger seat and noticed that the knob for the power reclining seat was missing. I pointed this out to the CA that sold us the car and they took it into the service department to have it looked at.

I'm in the loaner they gave me and just spoke with them again and they are saying the mechanic noted it during the inspection and it was not covered under BMW warranty, to fix it in his words, would cost "more than a couple hundred dollars"

Here's the thing, we drove the same car to the dealer with my friend driving and his gf in the passenger seat, i was seated directly behind her. I clearly recall her opening the seat for me to get in and adjusting it after I sat down as well. Keep in mind this was as we drove to the dealer for the CPO inspection and the car has been there for the last 2 days. When my mom sat in it today, the seat back was near a fully reclined position.

Anyone know what are my options here? I'm going to email the dealership owner and see what they have to say but I really don't want to pay over 1k to fix something that should have been taken care of or at least brought to my attention. Technically, I haven't taken delivery yet, right?

Sounds like it's their word against yours. Do you need a whole new seat just for the plastic piece missing?

Just by looking at it the plastic knob is missing, and there are two small holes. But since he told me it would be more than a few hundred dollars to fix, I would assume that they have to either replace to whole seat or take it apart.
