Can you Lemon a CPO?
Hey guys i purchased my 07 e92 335 w/18k on jan 4th of 2010. The HPFP went out the day i purchased the car so they gave me a loaner and got my car back to me the next day. Now im at 18500 and having loss of power/long cranks. Now this would be the 4th HPFP replacement on the car
1st @ 7k (previous owner) 2nd @9k (previous owner) 3rd @ 18k (Day that i purchased the car) 4th @ 18500, hasnt been changed or diagnosed by BMW yet. So what would you guys do if you were in my situation? I also have a concern about getting my fuel pump changed for a 4th time. I just read a few threads about the dealerships trying to cover up HPFP replacements with Injector swaps. Is there any way to document what specific HPFP i have so i can tell if they do indeed change the pump? thanks guys PS; Im in Cali |

You can probably find the HPFP part numbers on the service history. You may be able to find out if the car was a buyback (pretty much a lemon), if so you may have a case.
I don't know too much about it, but I'm sure someone can give some more details on how to do it.

The laws will vary state to state also. So, you might want to post this in the California specific forums. Since it is a used car, it definitely complicates matters. Your low mileage helps, though. I had a friend with a used car she was trying to lemon law in VA. She was able to tell all her details to a lawyer for free before he accepted/denied her case. That way you can see if you have a case or not.

The lemon laws only apply to new cars in most states I believe this is the case in CA. Having said that BMW will fix it and they are giving you a loaner so it is not the worst case scenario.

It was bound to happen. Everyone with the buybacks unloading the junky cars BMW could never fix; this is why there are so many great deals out there for used 335is. Chances are...if you bought a used 335i, the clock is ticking and counting down. You're better off to buy new.
