If you dont get attached to your car that hard I'd say lease...

Then get a clean used. Make sure to get the AA FMIC which is a must in my openion with any tune running in higher stages.

I bought my 07 as CPO from Crevier on December of 08. it had 15,500 on it with all options except the cold weather package. I paid $33,600. I have seen nothing but good from their preowned facility and people working there. Plus they give you good loaners. I got a 135i conv for loaner when I took my car in for service... and Fuck, I can't sleep

If you want to add mods, then I'd say buy. You can't go wrong with a CPO. The factory warranty is 4years/50,000 miles, the CPO warranty extends the coverage on the powertrain to 100,000 miles. If you're interested, you can find the complete listing of CPOs on BMW's website, that's how I found mine.
On the other hand, if you don't plan on keeping it, consider leasing, but you're likely to lose the money spent on mods. If you leave them on the car, you're basically giving them away when you turn the car in, and, depending on the mod, you may get charged to reverse what you have done. If you take the mods off, they may not be compatible with the next model car you buy/lease, but you can sell them to recoup some of the money spent on them.

i found one was repaint front and ear, but the dealer certified it...

It has to be fixed to BMW's standards to remain a CPO car. CPO doesn't mean no accidents/repaints/etc.

Three words: CPO! CPO! CPO!
Only way to go unless you don't care about taking a huge depreciation hit, not to mention getting any bugs sorted out before you get the car. I'll never regret my last 2 CPO purchases, and probably will not ever buy brand new again.

financially, makes more sense to NOT lease. However, if the lease rate is low enough, sometimes the lease cost is less than your typical depreciation.
