i got hit...just my luck

**update** she filed a claim against my policy, which means i'll probably have to pay a $500 deductible. stupid bitch told her insurance company that i backed into her. how do i get out of this?

I had just finished washing my car a nice NY day and decided to get some food. i backed out of my driveway when i noticed a car pretty far from me and not in my way at all, didn't think anything of it until the lady moved forward as i was backing up. i guess you can say i backed in to her car, or she set herself up to get backed up into.

this is the first time i did ANY damage to my car and i am so upset that this happened. luckily, her shitty subaru hatch back took all the damage with the fender dented and i walked away with just a few scratches. what's even more lucky is that just last night i picked up a new rear bumper and was so anxious to mount it but didn't find a shop that was open. good thing i didn't install it yet!

by her filing a claim, doesnt mean you have to pay your deduct... that means your insurance will go up... if you want to fix your damange under your policy THEN you have to pay the 500 deduct... get it?? very important... did you get a ticket? how does she have your info?if you didnt get the ticket she has no right to be using your insurance unless you kindly gave it out... (better to give her couple hundred for new bumper if your fault) cause you will save alot of $$ down the road...

how old are you?? car is in who's name? all that matters at this point if she is filing a claim...

in assigning blame, if you are in reverse and she is in drive then they will always assign 100% of the blame on your end, only way "out" of it is to pay her off so it won't affect your premiums in the future.

Don't bash the subaru, it crumbled it's bumper to save yours

you should've called the cops the second it happened. i never understand why people don't call cops and settle for exchanging insurance info. i don't care if i cause a 10 mile traffic delay on a highway, i'll still wait for the cops to show up. with that said, there's nothing you can do. your insurance rep will investigate the issue, get both yours and her account of the story and then decide whether or not you (and your insurance) are liable. if so, you pay, if not, it's going to be a long battle of he said / she said which might work out better in your case.

my next door neighbors were having people over and they all parked on the side of my narrow road. i couldn't refuse to give the info because they were all outside and they saw it happen, otherwise i would have just drove away..

if she is smart she will say she wants to get a quote from a body shop and tell them to quote high as hell...if you dont offer what she wants she will just file it and she knows you dont want that, the ball is in her court my friend...tell her you are a lawyer and try to out smart her, BUT PUT IT IN WRITING that you paid her and get it signed and the incident has been taking care of, no other claims can be made

if she had hit you on the side of your car (meaning she saw you and kept going straight), then she'd be at fault. but it looks like you backed into her -- you obviously saw her and misjudged your ability to pull out of the space before she reached you.

i dont see how she's a stupid bitch for telling the insurance company that you backed into her when that's actually what happened. take it like a man and move on.

and it would have been better if u installed it because you wouldnt have been at that moment at that point in time for that to occur. Hell, this thread would never even exist.

If I remember correctly, several sources including my insurance told me if I get in an accident where I was reversing and someone hit me, it is ALWAYS my fault no matter what. Unless there is a clear evidence that the person hit you with an intention of doing damage to you for other than "accidental" reasons (which will lead to a huge investigation as it could escalate into criminal act and fight between the insurance companies, but even this is hard to prove and win over), you are shit outta luck.

Thats why everyone says be extremely careful when you put that gear into "R". You are assuming alot of risk. You should always minimize the distance you are reversing.

Getting the cops involved won't help him with anything in this situation. They will just show up, take a statement from you, get a statement from her and since they weren't there to witness it or have any witness to testify, its your word vs hers. The cops are completely worthless.

I was rear ended and called the cops and thats exactly what they did. Got a statement from each party, issued some paperwork with the insurance/name/address exchange and moved on. No ticket for the person who rear ended me because they weren't there to witness it.

If you had your car in reverse, its 99.99% your fault. No way "out of it." Whoever was driving forward has the right of way. Either pay her for her damage from (1) insurance or (2) cash. No reason to call her a stupid bitch when it was clearly your fault. Imagine if someone backed his car into your car, then had the balls to call you a stupid bitch.

There isn't a way of getting out of it. You backed into her and you stated it yourself. You can't prove she set herself up for you to hit her, nobody does that.
