Would you lemon your 335i if you could?

The time has come for me to sign over my 07 e92 space/coral 335i back over to bmw. All i have to do is fax over the contract to my lawyer and its a done deal.

Its being lemoned due to 4 HPFP failures. Im having a bit of remorse because i really like this car but its giving me alot of problems. However, i got a really good deal on the car.

Bought it in Jan 2010 from a BMW dealership as CPO w/17,000 miles for

35k out the door and BMW financial paid my first two payments of $998.00 so basically i got the car for 35,000-2,000(bmw payments)-3,000(tax/license)= $30,000

and i even got the sweet .9%interest on my loan. I know I can get a nicer car for around this same price but its going to be hard to find a coupe/manual that is going to be this fast.

cars im considering (keep in mind im 23 so some of these may be too old mannish for me)

-Not in any particular order
2007 rs4
2006 m5
E46 m3
2004-2006 E55
2006 CLS55
2006 Z06
latest model NSX i can afford
96-98 supra ( i know they started in 93)
older gen Vipers (but they are sooo uncomfortable)
FD-RX7-LSX swap

Anyways, my whole reason of wanting to get out of the 335i was to get a car that would not depreciate as hard. This being a normal 3 series i feel that it will lose alot of value in the 3-4 years i expect to own the car. However, i just checked the KBB value for CPO from the dealership and it was 34,000 so it seems as if they are not depreciating as much as i had though.

If you were in my situation would you just sign the papers? (oh and i have paid 15,000 so far and they are going to give me a 15k check, so no loss on my part)

I'd go e92 m3 or e93 328 for sure if I could lemon

too many quirks to deal with it.

Though im not a fan of the cars you picked (different strokes)
for me I'd look at lotus, infiniti, hyundai, Cadillac (UGH).

if your worried about the car loosing it's value I believe its much ado about nothing. bmw's hold their value really well which is why lease rates are lower compared to other cars. your gonna take a hit on anything. Sounds like you want value and buying new doesnt = value.

If you meet the criteria for lemoning your vehicle, you should do so. That's the whole point of lemon laws, to establish what's acceptable and unacceptable in terms of reliability.

Go for the 2006 M5. All the others look old.

because the M3 is a lot of fun? i've found the 335i to be a really fun car, and i'm not bored of it yet.

the 328 is no where near as exhilarating as a 335 or m3 and judging from the list OP provided, he's looking at vehicles that produce a lot of fun for a bargain price. however, i don't think an 08 m3 will be that low in price for at least a little bit longer.

i'd go with the rs4 from that list

The 328i when paired with a manual is plenty exhilarating... I don't get the power obsession with this nation. It's all about lightness that makes track machines. Look at the GT3 RS; down on power compared to the 458 Italia but lighter and aerodynamically more sound, making it a full five seconds faster at The Ring even with a dinosaur manual.

If you already have your attorney involved and they contacted BMW regarding buying the car back (and they agreed), why would you change your mind now?

That's a tough Q. Can't say until I'm there. But reading all this about the issues I have nightmares about "should have" bought a 90-92 MK3 Supra Turbo 5spd and hooked it way up.

Wasn't this car already lemoned once before you bought it? Did your personal HPFP failures happen before or after all your modifications?

I'd take the money and run. You're getting a fair buyback on a USED car, that's pretty rare. If you really want to get out of the car, do it and don't look back. my 2c

because i still have the option of trying to get some cash back and keep the car. However i believe the amount would be small (3-5k). but i guess 5k cash and having the ability to turn around and sell the car would be nice. how much do you guys think i could get for my car and still sell it relatively fast?

Also has anyone had any luck getting some money back rather than a full lemon buy back?
