Bad Audi Man
I park in a monthly parking garage downtown near work everyday. I discovered damage on my rear right bumper, scratches, and a little cracking on the bumper corner when I left work one day. A lawyer in his new Audi A4 cabrio did it - i discovered when I looked around the lot the next day and saw his car with the same damage and pieces of my e90 plastic bumper on his left rear bumper by his tire. His paint was on my bumper as well. I left a note on his car for him to call me. He called, admitted that he did it, told me he was a lawyer, and that we would not give me his insurance information because it was my fault i was sticking out of the parking space. Other than reporting it to my insurance, any other action i should take against this $%^&*?? or anything I can do to get him to pay for it?

Take Photos Call Cops
Take some photos of his bumper, call the cops and force a settlement.

Claimed it's your fault cuz it was sticking out of the parking space? B$!
As long the car is in between the two lines and not one tire is over, it's his fault for not manuvering around and avoiding in touching your car.

if he was moving and you were still, it's his fault. He's trying to intimidate you with the "I'm a lawyer." BS. report it to the cops, teh garag management, his bosses, etc. Make it very uncomfortable for him.

I don't know about that... I think he is trying to intimidate you into submission by throwing the fact that he is a lawyer out there. Do what the above poster mentioned. Take pictures, then call the cops. Record all of your conversation down on paper that you had with that guy. Just because you were sticking out a little, he is still at fault I believe. You can prove he hit your car with pictures, but he can't prove you were sticking out...

take pictures, call the cops, make sure they do something, preferably impound his POS car if all else fails take your key out and go to town on his paint (make sure to find a new parking garage first)

BS! Your car was a stationary object that he hit while moving, it is all his fault that he cannot drive. The fact that he did not leave a note (being a lawyer he should know better) is hit and run, maybe leaving the scene of an accident?

Take photo and call you insurence. Long as he doesn't have the same insurence company as you do, your insurence should make the guy pay. Give your company the plate number and VIN (write it down when no one is looking) of the car and they might be able to find the insurence company.

I would just give the information to my insurance company and ask them to sic their own legal department on the ne'er-do-well lawyer. He has my sympathy, being a lawyer and all, but I still think he's expected to have his vehicle under control at all times.
This being Chicago, one might ask: "Under similar circumstances, what would Alphonse Gabriel Capone do?" and "How much time did Big Al spend in the slammer?" |

That totally sucks...
I would document everything, as the other posters have said. I would first get an accident report from the police--you will need this in the worst case scenerio that you cannot collect anything from him and must use your own company for repairs. I would also collect everything that you have done, such as when you talked to him, exactly what he said, etc. It does appear that this would be his fault, for the simple fact that he was moving and you were not. It doesn't really matter that you were supposedly over the line of the parking space--he has a duty as a diligent driver not to strike other vehicles--you must avoid contact if at all possible, so even if you were sticking out, he has a duty to avoid hitting your vehicle. I think approaching him in your building or at his law firm--if he is indeed a lawyer--could spell trouble for you--You would not want to compound the problem by making a scene or having him call the cops on you--I would simply do my best to handle the situation through the proper channels. Good luck.

He has admitted to you he hit you. Of course he will say he didn't but it will be hard to recant if you have photos......
Also, get moving on this.... He is obviously a prick so turn up the pressure on him. You have nothing to lose except a deductible.... Can the Illinois Bar association, call his office, call everybody he knows and call him out.....

I would honestly destroy his car. There is no way to prove that you did it. I would make that car literally be claimed totalled, just because he is a scumbag. I hate people like that. Just kindly tell him that obvsiously him being a lawyer, he has achieved some sort of intellectual level hopefully, and if he is a mature adult, tell him that you do not want to take this situation personally into your own hands, and it would be better off to just pay for the damages since 300$ will be alot less of a headache, and cheaper then what he would have to pay in the ongoing future if he does not agree to it. =)
