I am 90% sure that is normal. When I had my seats out for cleaning, I noticed they didn't sit flush with the floor but I didn't investigate at the time. If you look at pictures of the seat here: http://www.ecstuning.com/BMW-E92-M3-...ats/ES2603002/

You can see the right bracket is supposed to be a bit tilted.

That said, the 10% doubt comes from your photos where it looks like both sides are kinked inward, with the right side more dramatically so. Maybe someone dropped it? I'd say you're probably fine.
