Reckless driving - VA

Guys,
I got a reckless driving ticket in Loudon county today for doing 70 in a 40 speed limit zone.
Court date is in June.
Any good lawyers who could help reduce this to a speeding ticket?

My wife used Matthew Snow in Leesburg http://loudounlawyers.com/leesburg-attorneys/ for a reckless. She was doing 76 in a 55 on route 7 near Children's Rd. Had it dropped down to "failure to obey a road sign" and a $100 fine. Lawyer cost us $600.

Fuck VA, I'm never going back. Way to encourage tourism by forcing people to go back to your shit state for court.

Use a detector. It's a small fine ( less than $100) and no points. I've been using one for over a decade and only have one speeding ticket in that time frame.

Generally, anything 20 mph over is reckless. Over 50 mph in a 35 is reckless.

Over 80mph is reckless as well. If you go fast enough you go to jail.

My understanding of it is that it's often at the officer's discretion. If it's raining sideways with near-zero visibility and you're doing 55mph, even in a 55mph zone, it could still be considered reckless (or "too fast for conditions" or whatever you want to call it).

I'm no lawyer so I could be wrong, but I suspect those laws are intentionally vague to give officers more leeway. Whether or not you agree with it is another argument altogether.

Worst state to drive in. I've had 3 reckless. It's considered in the same category as DUI! Just crazy. It's just to make money. They make you go to court and can't even pay fine until you go in front of a judge. That's why you have to get a lawyer. Good luck.

I used to live in Tysons, got a wreckless merging on 495 to avoid a herd of upcoming traffic. Fairfax and VA state troopers don't play around. My lawyer cost me $500. Hated the Toll Rd and 66!

I have had two reckless driving tickets in VAand it is a big pain. Get a lawyer, and just pay the legal costs to have representation and get it argued down to regular speeding.

I can get my lawyer's into if you are interested.

You will start getting junk mail offers for legal representation as soon as your ticket shows up on the docket.

VA = cruise control and forget it!

Have you ever had your detector taken from you? I know they have to give it back but I assume its a pain. I just rely on Waze app. So far, it has only saved me from tickets.

I have had a passport with laser detection for 8 years living in Loudoun. Never had a ticket. Haven't had a speeding or radar ticket ever.

WOW. That's rough in VA. Here in Florida when you get any ticket, you pay $59 to a TV lawyer and it'll either get dismissed or adjudication witheld, no points, small fine, you don't have to go to court. Just give the lawyer the number on the ticket and on with your day. I couldn't imagine $600 for a traffic lawyer, reckless driving for speeding, etc. That's wild.

OMFG. I just read the Jalopnik article. I've never in my life said I would make an effort to avoid a State, I find that stupid. But if that doesn't give cause to avoid VA, I don't know what does. Insanity. And you have a reckless driving ticket, too? No wonder you spend $600 to get that knocked down and avoid JAIL TIME.... that State is insane.

Reading that Jalopnik made me rethink that one time I was messing around with a SC civic during the middle of the night. Speeds got more than execsive. Boy, am I going to drive like a grama now.

They don't take your radar detector, they just write down the serial number and hand you a $40 ticket for defective equipment (plus fees).

If they catch you speeding and you have a detector, I'm not sure but I've always assumed they will cut you no breaks.

The issue is not the same across the Commonwealth.

I-95, I-81, and I-66 are very, very congested roads. Quite a while back the State Police got sick and tired of cleaning up dead bodies with a snow shovel and a bucket.

In the counties along the top of the state and bordering them, which are really scenic mountain country, they've had long-term problems with A-holes from NOVA, Philly, etc. making a day trip down there to blast around as fast as their tires will let them. I'm talking, passing people on double yellows, etc. This is true around Charlottesville (as in, several counties around) too.

In other places, LEOs are more like what you would meet everywhere. I have been sent back on my way with a talking-to more than once.

As long as you're not more than 20 mph over, you can get the ticket reduced to excessive speeding (assuming you didn't give the trooper any attitude). All you need to do is take the on-line driver improvement course and pass the test. Then either show up in court with an apology, or hire an attorney to appear for you.

If you're more than 20 over, you may well go to jail.

If you think it stinks, try a trip through Ohio on 95 some times.

Have lived in NOVA my whole life and have had my fair share of tickets in my 5 years of driving. Got my first reckless down here in Harrisonburg while I'm away at school and just had my reckless reduced yesterday in court. 1200 dollars in lawyer fees, it better have been reduced! Go to Maryland if you want to drive fast.. but go stay on the track for excessive speeds!
