F83 Back Seat Falling Down when top is down

Purchased a 2018 F83 ZCP a few months ago. If I'm riding on the interstate with the top down, the back seat falls down (not caused by braking). If I put the air diffuser in, it keeps the seat from falling down. Has anyone else had this problem?

i don't have this issue but i think the latch is broken? take a look

I’ve had this happen a few times. What ends up fixing it is if you kind of slam it to close it. Give it a loving but firm close
