Was it a used car? Did you have an opportunity to inspect it prior to purchase? Sucks, and don't mean to be harsh, but I would say you are SOL.

By the soliciting car fax is illegal and can result in severe penalties for any web site that condones it.

Thanks, I'm starting at the dealer and will go from there. It's a frustrating situation for a buyer and so far the dealer has yet to tell me to pound sand. They would rather not have that kind of publicity.

why should the dealer buy the car back?? (unless you have the carfax buy back thing or whatever) a car being painted is not always gonna be reported to car fax. Life's too short, if its' just cosmetic, and the car is good why not enjoy it.. Make sure no structural issues.

I somewhat agree with this. If you like the car and it has all the options you want, why not talk to the dealer and instead of a buyback maybe they will fix the paint job. Just a suggestion hope everything works out for you. Was it a bmw dealer? Its possible that the previous owner had some paint damage and paid out of pocket. Hence the clean car fax. Again good luck bud! Let us know how you make out.

Took 5 months to realize? How do you know it was damaged as opposed to just need a respray due to other factors (well water exposure, bird crap acid, hail storm, etc.).

Carfax only occurs if someone reports an accident. A single car accident that teh driver walks away from won't get reported.

Based on your description of the events it sounds like you will have no recourse with the dealer unless you can prove they altered the carfax report.

As long as the dealer provided you the necessary information in good faith and you accepted the car as is at the time of purchase I think you are SOL.

BTW this also happened to me - bought my M3 in feb with clean carfax, etc. Few months later I brought it to the shop to have a dent repaired and was informed that portions of the car had been resprayed previously. My car still looks and drives flawlessly though so what can you do? Just be happy.

Carfax will 100% not show or report all accidents. I just sold by 2006 wrx Sti and i was unfortunate enough to have been hit 3 times resulting in 2 doors fully replaced/ re-blended, and a front bumper/fender re-painted.

None of the above damage was reported to carfax and all was completed by a subaru dealer under warranty. The collision center did a killer job and you would have to have a very trained eye in the right light to tell which doors were replaced.

Being a private party sale I fully disclosed all repaired damage when i sold it and might have got more out of the car if i didn't, but thats not the way i do things.

Either way, the carfax doesn't mean shit when it comes to most repairs. I feel for you that you got hosed by the dealer but if you like the car and the repair was done professionally just live with it. Only downside is if/when you sell the car someone else might find out and try to gouge you on the value.

Sell it....never! I plan to have mine until the wheels come off then I will just sit in it.

Seriously, if its just a paint then so be it and see if the dealer can repaint it. If it took you that long to find it then I am sure the dealer was not aware to the fact thus they (the dealer) negotiated in good faith. However, if you can prove otherwise then that is a different story.

I agree with these guys. paint is paint, can be repaired more easily. mechanical issues are a whole different story.
